Entre os principais pedidos está a proibição de policiais militares aposentados ministrarem conteúdos educacionais. Para justificar, promotores mencionam um caso recente em que um policial foi gravado cometendo erros ortográficos graves ao escrever na lousa, mostrando falta de formação pedagógica. O MP ressalta que, apesar do governo alegar que os militares atuam apenas na disciplina, eles acabam desempenhando funções de ensino.

A ação também questiona normas sobre conduta e aparência impostas pelo programa, como obrigatoriedade de corte de cabelo padronizado, proibição de acessórios e restrição de manifestações de namoro nas escolas. Para o Ministério Público e a Defensoria, essas exigências ferem direitos fundamentais à personalidade, privacidade e liberdade de expressão de crianças e adolescentes.
Outro ponto do pedido judicial é a transferência compulsória de alunos que não se adaptam às regras militares para outras escolas estaduais. Segundo os órgãos, essa prática é ilegal e compromete o direito universal à educação. "As regras fazem tábula rasa das leis que regem a prestação do serviço público de educação", diz o texto da petição judicial.
Resposta do governo de São Paulo e próximos passos
A Secretaria Estadual da Educação de São Paulo ainda não apresentou resposta oficial à ação. Em posicionamentos anteriores, a pasta declarou que os policiais não ocupam o lugar de professores e que a presença deles visa a segurança e a elevação dos índices educacionais. As escolas cívico-militares compõem uma das principais propostas políticas de Tarcísio, baseadas em iniciativas lançadas no governo federal de Jair Bolsonaro.
Se a liminar for aceita pela Justiça, o Estado poderá ser obrigado a retirar imediatamente policiais das salas de aula e revogar as normas de estética, com previsão de multa diária de R$ 300 mil em caso de descumprimento.
