A decisão foi tomada pelo corregedor-geral Eleitoral, ministro Antônio Carlos Ferreira. Ele alega que a determinação de produção antecipada de provas não cabe ao TSE, conforme tinha sido requerido pelo partido de oposição ao governo federal.
O argumento do PL é de que a apresentação feita no Carnaval foi uma "apoteótica peça de marketing político-biográfico". Foi pedido que fossem resguardadas provas sobre o caso para um futura apuração sobre abuso de poder político e econômico.
Porém, o ministro afirmou que o partido poderia, ele mesmo, buscar essas provas, sem intervenção do TSE.
— A título de exemplo, o autor sustenta que esta via judicial é indispensável para que se evite o perecimento da prova e se garanta a paridade de armas para as Eleições 2026, sob o argumento de que a própria Administração Pública e a LIESA já se recusaram a fornecer extrajudicialmente as informações administrativas e financeiras solicitadas. Entretanto, não há nos autos comprovação acerca dessa alegação — afirma.
