Mônica Bergamo: Ministros do STF criticam PF por investigar Toffoli sem autorização judicial
O resultado da apuração foi entregue no começo da semana ao presidente da Corte, Edson Fachin, e acabou resultando, nesta quinta (12), na saída de Toffoli da relatoria do processo que investiga as irregularidades do Banco Master e de seu dono, Daniel Vorcaro.
"Não acho que isso seja aceitável, eu não gostaria disso para ninguém", disse o ministro André Mendonça, segundo relatos, na reunião em que os magistrados decidiram pela saída de Toffoli da relatoria do caso Master.
Ele foi o que verbalizou a crítica mais contundente, mas a maioria dos magistrados concordou com suas observações.
Para investigar um integrante do Supremo, a PF precisa de autorização da própria Corte.
Segundo ministros do tribunal, o relatório entregue pela corporação a Fachin deixa evidente que os indícios apresentados pela PF contra Toffoli não foram encontrados por acaso pelos agentes.
Magistrados entendem que houve, na verdade, cruzamento de dados e pesquisas inclusive em juntas comerciais.
"Não foi acidental, um encontro fortuito com indícios. Fizeram uma investigação à revelia do STF, e não poderiam fazer isso", afirma um integrante do STF à coluna.
"Não entregaram um material bruto à Corte. Toffoli foi efetivamente investigado", segue o mesmo ministro.
Defensores do trabalho da corporação divergem dessa conclusão. Afirmam que os policiais seguiram a regra e, de fato, enviaram a Fachin exclusivamente o conteúdo de mensagens do celular de Vorcaro que citavam Toffoli, sem avançar em qualquer tipo de investigação.
Apesar disso, os magistrados consideraram que a melhor decisão a tomar era a saída de Toffoli do caso, numa tentativa de estancar o desgaste pelo qual o Supremo estava passando.
A situação do magistrado se agravou depois que a Polícia Federal (PF) entregou ao presidente da Corte um relatório mostrando uma troca de mensagens entre Vorcaro, dono do Master, e seu cunhado, Fabiano Zettel, em que ambos discutem pagamentos para a empresa Maridt, que tem o ministro entre seus sócios.
Casado com Natália Vorcaro, irmã do banqueiro, Zettel chegou a ser detido pela PF. Ele funcionava como uma espécie de gerente do caixa do cunhado.
Nas mensagens, Vorcaro e Zettel citam o nome do magistrado e combinam as transferências, que seriam pagamentos pela compra de um resort que tinha a Maridt como sócia. Há menções a pagamentos recentes, feitos em 2025, ano em que o negócio foi concluído.
Toffoli declarou aos colegas que não era suspeito e que gostaria de permanecer na relatoria. Ele, no entanto, foi pressionado pelos ministros para deixar o caso.
