André Mendonça derruba obrigação de Ibaneis comparecer à CPI do Crime Organizado para falar sobre Banco Master e BRB – Money Times
O ministro do Supremo Tribunal Federal (STF) André Mendonça desobrigou o ex-governador do Distrito Federal Ibaneis Rocha (MDB) de comparecer à CPI do Crime Organizado. A convocação foi aprovada pela comissão e agendada para a próxima terça-feira (7).
Na decisão, Mendonça citou jurisprudência do Supremo no sentido de que o investigado tem a opção de não comparecer à sessão, com base do direito constitucional do investigado de não produzir prova contra si mesmo.
"Não obstante a importância superlativa da 'CPMI do Crime Organizado' e de sua atuação independente na apuração dos fatos certos e determinados que ensejaram a sua instauração (…), revela-se inafastável a garantia constitucional de qualquer investigado contra a autoincriminação, direito fundamental expressamente consagrado no art. 5º, LXIII, da Constituição da República", escreveu o ministro.
O entendimento dá a Ibaneis a escolha de ir ou não à CPI. Caso decida comparecer, ele tem o direito a permanecer em silêncio diante das perguntas dos parlamentares e a ser acompanhado de um advogado. Também tem a opção de não jurar dizer a verdade.
A CPI quer ouvir o ex-governador sobre a tentativa de compra do Banco Master pelo Banco de Brasília (BRB) e de venda de honorários a fundos administrados pela Reag. Ibaneis nega ter participado das negociações.
