O vídeo não tem qualquer relação com o caso do Banco Master. O trecho que circula nas redes é de 23 de abril de 2025 e tratava sobre o julgamento que define os limites para a quebra de sigilo de usuários da internet com base em buscas em sites de pesquisa.
O caso analisado foi apresentado pelo Google contra uma ordem judicial no âmbito das investigações do assassinato da vereadora Marielle Franco e de seu motorista, Anderson Gomes, em 2018.
No canal do STF no YouTube, a partir do minuto 38, é possível observar o momento em que Mendonça discute os limites da investigação e é interrompido por Moraes.
Para Mendonça, a quebra de sigilo de buscas na internet não poderia alcançar um grupo indefinido de pessoas. "Uma coisa é eu pegar um suspeito A, quebrar todos os e-mails dessa pessoa e vou ter as comunicações das pessoas com esse determinado indivíduo. Outra coisa é eu abrir para um número indeterminado de pessoas que falaram com outras N pessoas", afirmou Mendonça.
Alexandre de Moraes, por sua vez, discorda do ministro André Mendonça, que considerou a medida constitucional, desde que atendesse a critérios claros e devidamente fundamentados.
Para o Google, a quebra de sigilo com base em palavras-chave buscadas nas plataformas online viola a privacidade, a proteção de dados e as liberdades de comunicação garantidas pela Constituição Federal.
O julgamento foi paralisado em setembro de 2025, após o ministro Dias Toffoli pedir vista (mais tempo para análise).
