Em regime domiciliar, Bolsonaro foi levado sob justificativa de risco à ordem pública após a preventiva ser decretada. Na sexta-feira (21), a defesa solicitou ao STF que o ex-presidente fosse mantido em prisão domiciliar.
Na petição apresentada pela defesa ao STF, os advogados apontam os problemas de saúde de Bolsonaro como justificativa.
"Diante de todo o exposto, dos laudos médicos atualizados e do caráter excepcional e humanitário que permeia a previsão do art. 318, II, do CPP, desde já – sem prejuízo dos recursos ainda cabíveis– requer-se: (i) a concessão de prisão domiciliar humanitária ao Peticionante, em substituição ao regime inicial fechado fixado na condenação, a ser cumprida integralmente em sua residência, sob monitoramento eletrônico e com as restrições que Vossa Excelência entender cabíveis; (ii) a autorização para deslocamento exclusivo para tratamento médico, mediante prévia comunicação ou, em casos de urgência, justificativa no prazo de 48 horas e; (iii) o reconhecimento da natureza humanitária e excepcional da medida, assegurando-se o direito à continuidade do tratamento clínico integral", diz o documento.
Desde 4 de agosto, Jair Bolsonaro cumpre prisão domiciliar por desrespeitar medidas cautelares e também em função das investigações do inquérito sobre o tarifaço dos Estados Unidos contra o Brasil, do qual seu filho, o deputado federal Eduardo Bolsonaro (PL-SP) também faz parte. O ex-presidente foi condenado a 27 anos e três meses de prisão, por tentativa de golpe de Estado, mas a condenação, que não transitou em julgado, segue em fase de recursos.
