PGR pede arquivamento de processo contra Zambelli por obstrução de Justiça
O inquérito 5.001 foi instaurado após declarações públicas feitas por Zambelli quando estava foragida na Itália. Segundo a Procuradoria-Geral da República, as falas não tiveram efeitos concretos e permaneceram no plano discursivo. Para o Ministério Público, não há elementos suficientes para justificar a continuidade da investigação.
No parecer enviado ao STF, Gonet argumenta que as diligências realizadas não encontraram provas de crime. "Uma vez esgotadas as diligências complementares, não se vislumbram elementos aptos a embasar o início do processo penal, tampouco linha inquisitorial voltada à obtenção desses elementos. A manifestação é pelo arquivamento do feito, diante da insuficiência de evidências quanto à materialidade delitiva e em razão do exaurimento de hipótese investigatória idônea, sem prejuízo do disposto no art. 18 do Código de Processo Penal", afirmou a PGR.
A ex-deputada bolsonarista deixou o Brasil em 3 de junho de 2025, logo após ser condenada pela Primeira Turma do STF a dez anos de prisão por invasão de dispositivo informático e falsidade ideológica no sistema do Conselho Nacional de Justiça. Na época, o ministro Alexandre de Moraes abriu nova investigação após entrevistas em que Zambelli indicou a intenção de mobilizar autoridades estrangeiras.
No entendimento da Procuradoria, a prisão da ex-parlamentar e o avanço do processo de extradição reduziram qualquer possibilidade de interferência nos processos brasileiros.
"O cumprimento da prisão da ex-parlamentar, associado às demais evidências colhidas, reforça o esvaziamento do potencial delitivo das ações da investigada. É verossímil, portanto, que o projeto delituoso tenha se limitado ao nível da retórica, sem significativa exteriorização de atos executórios", destacou o parecer.
A Justiça italiana deve decidir até a próxima quarta-feira (18) sobre o pedido de extradição apresentado pelo Brasil. Zambelli está presa desde julho de 2025 na penitenciária feminina de Rebibbia, em Roma. O tribunal pode autorizar a extradição, negá-la ou solicitar novos documentos antes de anunciar a decisão final.
