Embora Toffoli tenha deixado o comando das ações, o STF não viu motivo para atender à Polícia Federal e torná-lo suspeito. Conforme a Corte, ela reconhece "a plena validade dos atos praticados" por ele em todos os processos vinculados ao caso.
Os ministros ainda expressaram "apoio pessoal" a Toffoli, "respeitando a dignidade de Sua Excelência, bem como a inexistência de suspeição ou de impedimento. Anote-se que Sua Excelência atendeu a todos os pedidos formulados pela PF e PGR".

"Os dez ministros do Supremo Tribunal Federal, reunidos em 12 de fevereiro de 2026, considerando o contido no processo de número 244 AS, declaram não ser caso de cabimento para a arguição de suspeição, em virtude do disposto no art. 107 do Código de Processo Penal e no art. 280 do Regimento Interno do STF.
Reconhecem, assim, a plena validade dos atos praticados pelo ministro Dias Toffoli na relatoria da Reclamação n. 88.121 e de todos os processos a ela vinculados por dependência.
Expressam, neste ato, apoio pessoal ao exmo. min. Dias Toffoli, respeitando a dignidade de Sua Excelência, bem como a inexistência de suspeição ou de impedimento. Anote-se que Sua Excelência atendeu a todos os pedidos formulados pela PF e PGR.
Registram, ainda, que a pedido do ministro Dias Toffoli, levando em conta a sua faculdade de submeter à presidência do tribunal questões para o bom andamento dos processos (RISTF, art. 21, III) e considerados os altos interesses institucionais, a presidência do Supremo Tribunal Federal, ouvidos todos os ministros, acolhe comunicação de Sua Excelência quanto ao envio dos feitos respectivos sob a sua relatoria para que a presidência promova a livre redistribuição.
A presidência adotará as providências processuais necessárias, para a extinção da AS e para remessa dos autos ao novo relator".
