Suspeito de incendiar loja em Fortaleza é solto
A Justiça do Ceará concedeu liberdade provisória, mediante uso de tornozeleira eletrônica, a Lucas Mendonça Rodrigues, preso em flagrante após atear fogo em uma loja de calçados que fica dentro do shopping Solares, na avenida Valdir Diogo, no bairro Novo Mondubim, em Fortaleza.
O crime ocorreu na madrugada da última quinta-feira 12, por volta das 4h. A decisão foi proferida nesta sexta-feira, 13, pela 17ª Vara Criminal, vara de audiências de custódia.
Conforme decisão obtida pelo O POVO, o magistrado homologou o flagrante, mas entendeu que não havia necessidade de manter a prisão preventiva, uma vez que o autuado é réu primário, possui bons antecedentes, residência fixa e trabalho lícito como marceneiro.
De acordo com o auto de prisão, Lucas foi detido logo após causar o incêndio que destruiu completamente a estrutura da loja Havaianas. Não houve feridos e o crime não envolveu o emprego de arma de fogo ou violência física direta contra pessoas.
Defesa afirmou que suspeito sofria perseguição por organização criminosa
Em depoimento, a defesa relatou que o suspeito vinha sofrendo "situações de perseguição prévia e intimidação por organização criminosa". O magistrado observou que o homem apresentava uma "séria lesão na mão", fato que deverá passar por averiguação detalhada durante a instrução do processo.
Lucas deverá cumprir uma série de medidas cautelares pelo prazo inicial de seis meses. Além do monitoramento eletrônico, ele está sujeito a proibição de sair de casa das 19h às 07h, inclusive aos finais de semana e feriados, salvo para trabalho comprovado.
Além disso, está proibido de se aproximar da loja vitimada, não poderá se ausentar de Fortaleza por mais de oito dias sem comunicação prévia à Justiça e deve se apresentar mensalmente à Coordenadoria de Alternativas Penais.
O Ministério Público do Estado do Ceará (MPCE) não solicitou a conversão da prisão em preventiva durante a audiência.
Suspeito quebrou parede para se esconder
Segundo o relatório da 4ª Companhia do 1º Batalhão de Bombeiros Militar, no quartel do José Walter, a equipe foi acionada às 3h54min para a ocorrência no interior do Shopping Solares.
Ao chegarem ao local, os bombeiros precisaram realizar uma entrada forçada pela fachada principal do centro comercial para conseguir acesso seguro e combater as chamas, que atingiram um quiosque da marca.
Após o fogo ser totalmente debelado e realizado o rescaldo para evitar que as chamas se alastrassem, a equipe fez uma varredura na área com o apoio da Polícia Militar.
Durante a inspeção, o suspeito foi localizado escondido dentro de uma loja vizinha. De acordo com o Corpo de Bombeiros, ele havia arrombado uma parede do estabelecimento adjacente para tentar se esconder.
Foi necessária uma nova entrada forçada para a contenção do indivíduo, que foi detido pela composição da Polícia Militar comandada pelo 2º tenente Clayton.
Foram registrados danos materiais à estrutura do quiosque e da loja vizinha, mas não houve registro de feridos. O supervisor de segurança do shopping acompanhou a ação.
