Messod Azulay Neto, ministro do Superior Tribunal de Justiça (STJ), foi responsável pela decisão de negar o pedido de habeas corpus (HC) apresentado pela defesa de Pedro Turra. O magistrado considerou o recurso prejudicado.
Conforme apontou o documento, obtido pela CNN Brasil, a solicitação do HC questionava decisão de um desembargador do Tribunal de Justiça, que tinha negado, liminarmente, o pedido na instância anterior.
Ao avaliar o caso, o ministro destacou que, exceto em situações excepcionais, não cabe habeas corpus contra esse tipo de decisão, sob pena de supressão de instância.
Os autos destacaram que a prisão preventiva foi decretada sob o fundamento de garantia da ordem pública e conveniência da instrução criminal, baseada na gravidade concreta dos fatos, indícios de reiteração delitiva e suposta tentativa de combinação de versões.
Turra, que virou réu por homicídio doloso (quando há intenção de matar), está preso desde o dia 30 de janeiro, acusado de espancar o adolescente depois de uma briga motivada por um chiclete, em 24 de janeiro, em Águas Claras, no Distrito Federal (DF).
Jovem não resistiu
Rodrigo Castanheira, de 16 anos, permaneceu 16 dias hospitalizado em Brasília, em estado grave, após sofrer traumatismo craniano e ter uma parada cardiorrespiratória que durou 12 minutos. O jovem ficou em coma induzido e acabou morrendo no dia 7 de fevereiro.
Turra é investigado em outras três ocorrências de 2025: fornecimento de bebida alcoólica a menor de idade, lesão corporal e constrangimento ilegal.
