O presidente do Supremo Tribunal Federal (STF), Edson Fachin, arquivou neste sábado, 21, a ação que questionava a atuação do ministro Dias Toffoli como relator das investigações sobre as fraudes no Banco Master na Corte. O arquivamento da chamada arguição de suspeição se deu por "perda de objeto", já que Toffoli deixou a relatoria do caso, que foi redistribuído para o ministro André Mendonça.
Com isso, Toffoli ainda poderá participar de eventual julgamento do processo, a não ser que se declare suspeito futuramente - impedido de participar por ter ligação com as partes ou outro interesse no caso.
Em 12 de fevereiro, depois de uma tensa reunião - que teve o conteúdo gravado e vazado - uma nota assinada pelos dez ministros do STF anunciou que Toffoli havia decidido deixar a relatoria do processo. Isso ocorreu um dia depois de a Polícia Federal entregar ao presidente Fachin relatório em que listava menções a Toffoli em conversas retiradas do celular de Daniel Vorcaro, dono do Master, e também conversas entre o ministro e o banqueiro.
A PF apontou a possível existência de indícios de crimes nos fatos e a possibilidade de suspeição caso Toffoli continuasse como relator. Na nota divulgada à época, os ministros do STF, porém, disseram "não ser caso de cabimento para a arguição de suspeição".
O Master foi liquidado em novembro do ano passado pelo Banco Central (BC) e é investigado por fraudes de R$ 12 bilhões.
