O processo teve início após a denúncia de que um homem de 35 anos mantinha um relacionamento amoroso com uma adolescente de 12 anos em Minas Gerais. Em primeira instância, a Justiça havia condenado o réu a nove anos e quatro meses de prisão em regime fechado, sentença que também atingia a mãe da menina por considerar que ela falhou no dever de proteção.
No entanto, em uma decisão que gerou forte repercussão jurídica, o TJMG decidiu, por maioria de votos, absolver ambos os réus e anular a condenação anterior. O desembargador Magid Nauef fundamentou seu voto argumentando que o envolvimento possuía um "vínculo afetivo consensual" e ocorria de forma pública, com o consentimento dos pais.
