TSE suspende eleição de Senador Sá e prefeito afastado volta
O ministro Ricardo Villas Bôas Cueva, do Tribunal Superior Eleitoral (TSE), suspendeu temporariamente as eleições suplementares de Senador Sá, município distante 268 quilômetros de Fortaleza. O pleito estava marcado para o próximo domingo, 1º, já a decisão do relator foi tomada nesta quarta-feira, 25. Com a decisão, o prefeito afastado Bel Júnior (Progressistas) reassume o cargo.
"No caso, em análise preliminar, verifico que, não obstante a determinação desta Corte, no novo acórdão do TRE/CE (Tribunal Regional Eleitoral do Ceará) não foram especificados os pontos omissos e controvertidos necessários para se compreender o cenário fático submetido a julgamento", justificou.
A eleição suplementar em Senador Sá definiria os substitutos do prefeito Bel Júnior e da vice-prefeita Professora Maria, ambos do PP, cassados em novembro de 2025 por irregularidades no evento denominado "Cavalgada do Bel".
Havia apenas uma candidata na disputa, apoada por Bel Júnior: Sabrina Morais, que adotou Sabrina do Bel como nome de urna.
Em decisão liminar, Villas Bôas mencionou que uma determinação da ministra Isabel Gallotti, antiga relatora do caso no TSE, não foi cumprida "a contento" pela Corte Regional, referindo-se à especificação das falas, slogans ou comportamento de Bel que configurasse showmício.
"Por outro lado, o requisito do perigo da demora também está presente, tendo em vista a proximidade da data prevista para o pleito suplementar e os efeitos deletérios da alternância de poder na chefia do Poder Executivo", complementou o magistrado.
Relembre o caso
O TRE-CE já havia determinado anteriormente a cassação da chapa e a realização de nova eleição. Em junho de 2025, contudo, o TSE suspendeu liminarmente o pleito, que estava marcado para o julho seguinte, e manteve Bel no cargo.
A Corte Regional, porém, julgou os embargos de declaração do prefeito e decidiu por unanimidade cassá-lo novamente, determinando mais uma vez a realização de novas eleições. Além da cassação, Bel foi declarado inelegível.
O prefeito, por sua vez, entrou com pedido de efeito suspensivo na Corte Superior. Ou seja, ele solicitou a suspensão temporária dos efeitos da decisão que cassou o mandato para permanecer no cargo enquanto o recurso é analisado pelo TSE.
"Ante o exposto, defiro o pedido de efeito suspensivo ao acórdão do TRE/CE até o referendo desta decisão liminar pelo Plenário desta Corte e, caso referendada, até o julgamento do recurso especial", finalizou Villas Bôas nesta quarta.
