Mendonça dispensa irmãos de Dias Toffoli de comparecer à CPI do Crime Organizado
Mendonça aceitou um pedido das defesas de José Eugênio e José Carlos Dias Toffoli para que eles não precisem comparecer à comissão porque os requerimentos evidenciariam que eles foram convocados na condição de investigados, e não de testemunhas.
"Revela-se inafastável a garantia constitucional de qualquer investigado contra a autoincriminação, direito fundamental expressamente consagrado no art. 5º, LXIII, da Constituição da República", disse o ministro, em sua decisão.
Ele decidiu "afastar a obrigatoriedade de comparecimento, transmudando-a em facultatividade, deixando a cargo dos requerentes a decisão de comparecer, ou não, à 'CPI do Crime Organizado'".
A aprovação do requerimento para convocar José Carlos, que é padre, e José Eugênio, engenheiro, aconteceu nesta quarta-feira (25), em conjunto com a decisão de quebrar o sigilo da Maridt Participações, empresa da qual o próprio Dias Toffoli é sócio.
Como a Folha revelou, a empresa recebeu pagamentos de fundo ligado ao Banco Master pela venda de parte do resort Tayayá, no Paraná.
O requerimento, de autoria do senador Alessandro Vieira (MDB-SE), solicitou ao Coaf (Conselho de Controle de Atividades Financeiras) "que se proceda à transferência dos sigilos bancário, fiscal, telefônico e telemático da empresa Maridt Participações S.A.", além do envio do RIF (Relatório de Inteligência Financeira) da companhia à comissão.
