CPI do Crime Organizado: irmãos de Toffoli não precisam depor
A comissão aprovou nesta quarta-feira (25) as convocações de José Eugênio Dias Toffoli e José Carlos Dias Toffol i para depoimento sobre as transações financeiras ocorridas entre a empresa Maridt Participações, da qual o ministro e seus irmãos foram sócios, e um fundo investimentos ligado ao Banco Master.
A Maridt integrou o grupo Tayayá Ribeirão Claro, responsável pelo resort Tayayá, no Paraná, e começou a vender sua participação no empreendimento em 2021.
Na decisão, André Mendonça atendeu ao pedido da defesa dos irmãos de Toffoli e afirmou eles foram tratados pela CPI na condição de investigados.
Dessa forma, segundo o ministro, eles não são obrigados a produzir provas contra si mesmos e o depoimento deve ser facultativo.
Além disso, a defesa destacou que eles poderiam sofrer ameaças de responsabilização penal durante a oitiva.
"Há jurisprudência do Supremo Tribunal Federal, no sentido de que o direito de um investigado a não autoincriminação abrange a faculdade de comparecer ou não ao ato", decidiu o ministro.
Caso eles decidam ir à comissão, eles poderão permanecer em silêncio, não precisam ser submetidos ao compromisso de dizer a verdade e não podem sofrer constrangimentos físicos ou morais.
De acordo com o senador Alessandro Vieira (MDB-SE), relator da CPI, há suspeitas de que a Maridt atuou como empresa de "fachada" para lavagem de dinheiro.
Também foram aprovadas, na mesma sessão da CPI, a convocação de Daniel Vorcaro, dono do Banco Master, e a quebra de sigilo bancário, fiscal, telefônico e telemático do Master, da empresa Maridt Participações e da empresa Reag Trust Distribuidora de Títulos e Valores Mobiliários.
