Tribunal de Justiça da Bahia mantém improcedência de ação sobre empréstimo e aplica multa por má-fé
Na decisão de primeiro grau, os pedidos foram negados, o que levou a autora a interpor recurso inominado. Ao relatar o caso, a juíza Leonides Bispo dos Santos Silva reconheceu que se tratava de relação de consumo, com aplicação do Código de Defesa do Consumidor às instituições financeiras, conforme entendimento consolidado na Súmula 297 do Superior Tribunal de Justiça.
Diante da negativa de contratação, cabia ao banco comprovar a regularidade do vínculo, nos termos do artigo 373, inciso II, do Código de Processo Civil. Segundo a relatora, a instituição financeira apresentou o contrato devidamente assinado pela autora, comprovando a contratação do empréstimo que originou os descontos.
Com isso, a Turma afastou a alegação de ato ilícito, entendendo que os débitos decorreram de obrigação regularmente assumida, caracterizando exercício regular de direito e afastando qualquer dever de indenizar.
Litigância de má-fé
Além de negar provimento ao recurso, o colegiado reconheceu que houve tentativa de induzir o Judiciário a erro, com alteração da verdade dos fatos, hipótese prevista no artigo 80, inciso II, do CPC. Por essa razão, foi aplicada multa por litigância de má-fé.
A sentença foi mantida por seus próprios fundamentos. A autora foi condenada ao pagamento de custas processuais e honorários advocatícios fixados em 20% sobre o valor da causa, cuja exigibilidade permanece suspensa em razão da gratuidade da justiça.
Ofício ao NUCOF
A relatora também determinou o envio de ofício ao Núcleo de Combate às Fraudes do Sistema dos Juizados Especiais (Nucof). A medida foi adotada diante da repetição de ações semelhantes na mesma comarca, várias delas julgadas improcedentes com reconhecimento de má-fé, para apuração de eventual prática de demandas fraudulentas.
