Mendonça determina que Coaf siga rito normal de relatórios no caso Master
O ministro do Supremo Tribunal Federal (STF) André Mendonça determinou nesta quinta-feira (26) que o Conselho de Controle de Atividades Financeiras (Coaf) deve seguir rito ordinário legalmente previsto para o encaminhamento de Relatórios de Inteligência Financeira (RIFs) relacionados ao escândalo do banco Master. Mendonça atendeu a dúvida do próprio Coaf.
A decisão foi proferida no âmbito do Inquérito 5.026, que tramita no Distrito Federal sob sigilo, e estabelece que o fluxo de compartilhamento dessas informações deve ocorrer conforme procedimentos padrão adotados pela Unidade de Inteligência Financeira para casos semelhantes. Diversos veículos de comunicação noticiaram que o fluxo dos relatórios era "atípico", seguindo ordens do antigo relator do caso, Dias Toffoli.
O Coaf provocou o STF para buscar orientações sobre como proceder com o envio de relatórios produzidos em decorrência das investigações. O ministro reforçou que essa diretriz se aplica tanto aos relatórios que já foram compartilhados quanto aos que venham a ser produzidos futuramente, fundamentando a decisão no artigo 15 da Lei nº 9.613/1998.
Mendonça já revogou outras medidas de Toffoli e autorizou o compartilhamento de dados obtidos por quebras de sigilo bancário, fiscal e telemático — que inclui registros de ligações, mensagens e acessos à internet — do banqueiro Daniel Vorcaro, dono do Master, com as equipes da Polícia Federal e a Comissão Parlamentar Mista de Inquérito (CPMI) do INSS no Congresso. Para o ministro, a gravidade dos fatos e a "elevada repercussão social" justificam a cooperação entre as autoridades.
