Lacuna na lei dá a Bolsonaro direito a seguranças e motoristas
Decisão nesse sentido foi tomada na sexta-feira (13) pela 4ª Turma do Tribunal Regional Federal da 6ª Região (TRF6) em Belo Horizonte.
Os benefícios haviam sido suspensos pela 8ª Vara Cível da capital mineira, em ação movida pelo vereador Pedro Rousseff (PT-MG).
Bolsonaro se valeu de uma lacuna da legislação (que não prevê casos como o seu, que vive na condição de presidiário, sem poder transitar ou fazer reuniões) e entrou com recurso no TRF6, questionando a suspensão dos benefícios.
A desembargadora federal Mônica Sifuentes, relatora do recurso no TRF6, que já havia concedido uma liminar autorizando a reintegração dos seguranças, reviu sua decisão e restabeleceu também os demais assessores e motoristas.
Os demais integrantes do colegiado entenderam, de maneira unânime, que, mesmo preso, ele deve continuar com os benefícios assegurados em lei.
Lei é omissa
Segundo a desembargadora, na lei que trata dos benefícios aos ex-presidentes não há nada que estabeleça "qualquer condição relacionada à liberdade de locomoção ou à inexistência de condenação criminal para a manutenção dos benefícios, tampouco prevê hipóteses de suspensão ou cancelamento em razão de encarceramento".
A conta da estrutura montada fora da prisão para atender Bolsonaro continuará sendo paga pela União.
Ela estará à disposição do ex-presidente o tempo que for preciso, mesmo que ele passe os próximos 27 anos na Papudinha, sem poder ir a lugar algum.
