Uma mãe denuncia que está há 4 meses sem ver os filhos mesmo tendo a guarda unilateral das crianças — que têm 4, 9 e 10 anos. As crianças moram com a mãe na Paraíba desde 2023, ano em que ela se separou após um casamento de 11 anos. No final do ano passados, eles vieram a Brasília visitar o pai e não voltaram. A mãe diz que o pai está impedindo o retorno dos filhos. O homem, que é um médico cirurgião, foi condenado por violência doméstica em 2023.
"Um pesadelo que nenhuma mãe deveria passar", é como a advogada descreve a situação.
Impedida de ver os filhos
Nas férias escolares no final de 2026, os filhos — como de costume — vieram visitar o pai em Brasília, porém estão desde o dia 12 de dezembro sem ver a mãe. As crianças foram, inclusive, matriculadas em uma escola do Distrito Federal.
A mulher então então entrou na justiça pedindo o cumprimento da sentença de guarda onde o pai tem o direito de visita e que após o período deve retornar os filhos à mãe, o que segundo ela não foi respeitado. A juíza da 3ª vara de família da Paraíba expediu um mandado de busca e apreensão de menores para que a mãe pudesse levar os filhos de volta para a sua casa, na Paraíba. No entanto, ela não conseguiu cumprir a decisão judicial.
Na útlima segunda-feira (9/3), a mãe foi para a porta da escola buscar as crianças, mas segundo ela, a unidade de ensino avisou o pai, que acionou a polícia militar para ir até o colégio e retirar a mulher do local. Ela disse que se sentiu humilhada pois estava há 4 meses sem ver os filhos pessoalmente e tinha esperança de revê-los na saída da escola.
O vídeo (veja acima) feito pela mãe dos meninos, mostra ela já fora da escola, sentada em uma calçada e conversando com um dos policiais que foram até o local. Indignada ela questiona a ação e diz ser um absurdo a forma como foi tratada. Segundo ela, na ocasião, as crianças foram rapidamente colocadas dentro de um carro enquanto o pai gritava a todo tempo para que ela fosse presa.
A advogada contou ao Metrópoles que está em sofrimento profundo pois chega a ficar dias sem ver os filhos e que a caçula, de apenas 4 anos, demonstra constantemente sentir falta da mãe, "nas videochamadas ela sempre pergunta quando eu irei buscá-lo e diz que está com muitas saudades de mim", revelou.
"Chegar em casa e a casa estar toda arrumada e ficar aquele silêncio, dói tanto! É uma dor imensa. Que crime uma mãe comete ao querer ver os filhos?!".
Condenação por violência doméstica
O vídeo (veja acima) gravado pela câmera de segurança da casa onde a família vivia em Brasília, em 2023, mostra uma discussão que após gritos, termina em agressão. O homem empurra a mulher contra a parede duas vezes diante de um dos filhos. Após sofrer uma queda, a criança corre até a mãe e a abraça. O caso gerou uma condenação do homem no Tribunal de Justiça do DF em 2023, ano que o casal se separou.
Guarda unilateral
No final do ano seguinte, a Justiça concedeu à mãe dos meninos a guarda unileteral das crianças. Ou seja, quando apenas um dos genitores tem responsabilidade legal sobre os filhos. Na decisão a qual o Metrópoles teve acesso, o juiz reconhece "que os filhos, desde a separação do casal, sempre estiveram sob sua companhia direta, cuidados diários, proteção emocional e rotina estruturada", e que o pai poderia vê-los durante as férias, como acontecia todas as vezes, desde o divórcio.
"O juízo final avaliou todo o contexto fático e probatório e concluiu, de forma fundamentada, que a permanência das crianças com a mãe atendia melhor aos seus interesses."
O documento ainda diz que o pai pode entrar com recurso para obter a guarda desde que apresente contraprovas signficativas e passíveis de revisão.
A mãe acredita que é o ex-companheiro está tentando atacá-la como forma de vingança pela condenação de violência doméstica. Ela também acredita que ele não devolveu os filhos pois não quer pagar a pensão alimentícia.
