Supreme Court forms 4-1 score against appeal on lifetime pension review

The Supreme Court formed a 4-1 score to deny an appeal from the National Confederation of Metalworkers that sought to guarantee the right to lifetime pension review for those who filed lawsuits until March 2024. Four justices voted to maintain the decision that vetoed the review, while only Dias Toffoli voted in favor of retirees.

The 'whole life review' is a mechanism that allowed retirees to opt for the most favorable calculation rule for recalculating their social security benefits. In March 2024, the STF ruled that retirees do not have the right to opt for the most favorable rule, understanding that the transition rule is mandatory and cannot be optional.
