Justice Edson Fachin, president of Brazil's Supreme Court (STF) and National Council of Justice (CNJ), created a working group on Friday (5th) to review all 'penduricalhos' — compensation benefits without legal basis — paid to magistrates nationwide. The group has 180 days to present a complete report on the current situation and draft legislation to regulate these payments.

According to the decree signed by Fachin, the objective is to 'conduct studies on legislative proposals regarding judicial compensation and its effects on improving the national public service compensation system.' The justice justified that the current system, created in 1998, generates 'inequality, legal uncertainty, lack of transparency and use of conceptual subterfuges disconnected from reality.'

The initiative follows CNJ's approval in late May 2026 of a unified payroll system for magistrates, prohibiting courts from creating extra payment sheets for benefits beyond regular salaries. A CNJ survey identified over 500 different types of penduricalhos paid by courts under distinct names.

The issue gained momentum in March 2026 when the STF endorsed Justice Flávio Dino's injunction suspending payment of various benefits not provided by law. The penduricalhos allow compensation well above the constitutional ceiling for public servants and are a source of criticism of the Judiciary.
