Children and dependents of femicide victims can apply starting this Friday (29) for a special INSS pension worth one minimum wage. The measure affects minors under 18 in social vulnerability situations — family income per capita equal to or less than R$ 353 (one quarter of the current minimum wage).

"Os filhos e dependentes de mulheres vítimas de feminicídio têm direito, a partir desta sexta-feira (29), a pensão especial do Instituto Nacional do Seguro Social (INSS). A norma regulamenta a concessão do benefício no valor de um salário-mínimo."

Besides biological children, stepchildren, minors under guardianship and those under tutelage who prove economic dependence on the victim can receive the benefit. Applications are made through the Meu INSS website, app or phone 135, and must be submitted by a legal representative — representation by the author, co-author or participant in the crime is prohibited.

"Além dos filhos biológicos, poderão receber o benefício enteados, menores sob guarda e tutelados que comprovem dependência econômica em relação à vítima. A solicitação pode ser feita pelo site ou aplicativo Meu INSS ou pelo telefone 135."

To prove femicide, INSS accepts arrest warrants, indictments, police investigation conclusions or judicial decisions. According to the federal government, the pension applies to cases prior to the regulation's publication: "Payment of the special pension is due from the date of application, even if the crime predates the law that instituted the right".

"O pagamento da pensão especial é devido a partir da data do pedido, ainda que o crime seja anterior à lei que instituiu o direito."

The benefit has no retroactive effect to the date of the victim's death — only from the application date. For dependents who are not children, a guardianship or tutelage term, provisional or definitive, is required.

3. What we don't know yet (3)
  • What is the specific normative act (ordinance, decree, resolution) that instituted the benefit?

Why it's still unknown: Consulted sources mention only 'regulation' generically, without identifying the type and number of the administrative act.

  • How many annually registered femicide cases could generate pension applications?

Why it's still unknown: No source presented estimates of potential beneficiary universe or fiscal impact of the measure.

  • How will INSS process femicide cases without definitive judicial conviction?

Why it's still unknown: The regulation accepts ongoing procedural documents, but doesn't clarify criteria for inconclusive cases.
