The Rio de Janeiro Public Prosecutor's Office (MP-RJ) has filed an appeal seeking to annul the trial that resulted in judicial pardon being granted to Henry Borel's mother, Monique Medeiros da Costa e Silva. Prosecutor Fábio Vieira dos Santos alleges that the reformulation of a question during jury voting contaminated the result of the jury trial that ended in the early hours of June 4, 2026.

According to the prosecutor, the controversy arose when the judge reformulated a question about whether Monique's omission was intentional in relation to the homicide. "The judge asked if Monique's omission was intentional. The jurors voted yes, and the yes answer, consequently, brings conviction for intentional homicide," Fábio Vieira told Estadão. The magistrate allegedly changed the question to "was the defendant's omission culpable?", inverting the scope of yes and no in the voting.

Monique's defense, represented by lawyer Florence Rosa, countered the prosecution's allegations. "This is absurd. Negligence is one of the substrates of culpability," declared the lawyer after the sentence reading. Jairinho's defense also announced it will file an appeal for annulment of the trial.
