PEC reducing workweek to 40 hours and ending 6x1 schedule postponed in Chamber

Deputy Mauricio Marcon (PL-RS) requested collective consideration on Monday night (25) and postponed the vote on the Constitutional Amendment Proposal (PEC) that establishes the end of the 6x1 work schedule in the Chamber of Deputies special commission. Rapporteur Leo Prates (Republicanos-BA) had presented his opinion providing for reduction of working hours from 44 to 40 weekly hours, without salary reduction, with a 14-month transition after promulgation. ✓

The PEC establishes two days of paid weekly rest, one preferably on Sundays, with staggered implementation: reduction from 44 to 42 weekly hours within 60 days after promulgation and reaching 40 hours after another 12 months. The text provides that workers with higher education and remuneration above R$ 21,188.87 — two and a half times the INSS ceiling — are exempt from working hour control rules, except public servants. ✓

Chamber President Hugo Motta (Republicanos-PB) had earlier announced an agreement with President Lula to enable voting still this week, with three points considered 'non-negotiable': reduction of working hours to 40 hours, end of 6x1 schedule and prohibition of salary reduction. The proposal allows collective agreements to establish compensatory regimes for sectors with uninterrupted activities, provided they ensure two days of weekly rest on monthly average. ✓

The special commission vote was rescheduled for Wednesday (27), with expectation to proceed to the plenary on Thursday (28). For approval, the PEC needs minimum support of 308 deputies in two rounds in the Chamber and subsequent analysis in the Senate. The text also provides that complementary law may establish transitional measures for MEIs and small companies, conditional on maintaining employment levels. ✓
